CONDITIONS OF SALE

Placing orders

By placing an order through our website, you agree to be bound by these Conditions of Sale. You must review and understand these Conditions before submitting your order.

We reserve the right to update these Conditions from time to time however the version in force at the time of your order will apply to that order.

 

Order acceptance

Your order constitutes an offer to purchase the relevant product. We will confirm acceptance of your order by issuing a written order confirmation. No contract will exist between you and us until such confirmation has been issued.

We reserve the right to refuse an order at our discretion, including where we are unable to fulfil it or where pricing or product information has been published in error.

Pricing & Payment

Prices are indicated in Great British Pounds (£). The Seller (Studio MARSA LTD) is not VAT registered therefore no VAT is charged on any orders.

Prices are listed exclusive of delivery charges unless otherwise stated. Where applicable, delivery costs will be notified to you before your order is confirmed. Payment must be made in full at the time you submit your order.

 

Lead times

All pieces are made to order in our London workshops. Estimated lead times are approximately 4–6 weeks from the date of order acceptance. Lead times are estimates only and may vary depending on material availability and workshop capacity. We will notify you when your order is ready for dispatch. Time for delivery is not of the essence.

Shipping & Delivery

We aim to ensure that all pieces are delivered safely and efficiently. Delivery options will be discussed with you at the time of order, and any agreed delivery charges will be set out in your invoice.

Risk in the products passes to you upon delivery. Title to the products will pass only once we have received full payment.

International customers are responsible for all customs duties, import taxes, and local clearance charges.

 

Cancellations, Returns & Exchanges

All our pieces are made to order and are customised or personalised to your specifications. Accordingly, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the usual cancellation rights do not apply to your order.

Once an order has been accepted, it cannot be cancelled, and products cannot be returned or exchanged, except where the item is faulty or not as described.

If you believe your product is defective, you must notify us in writing within 7 days of delivery, providing reasonable evidence of the issue. Your statutory rights are not affected.

 

Materials & Craftsmanship

Our materials are sourced from reputable suppliers within the UK and each piece is handcrafted. As a result, natural variations in colour, grain, finish or texture may occur. Such variations and minor irregularities are inherent to the artisanal process and shall not constitute defects or non-conformities. We do not guarantee that the colours displayed on your device accurately reflect the colours of the finished product.

 

Liability

Nothing in these Conditions excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited.

Subject to the above, we shall not be liable for:

​

  • any indirect or consequential loss, including loss of profit, loss of business, or loss of opportunity;

  • delays or failure to perform caused by events beyond our reasonable control;

  • inaccuracies in product descriptions caused by variations in natural materials or display differences on electronic devices, provided the product is otherwise as described.
     

Our total aggregate liability in respect of any order shall not exceed the amount paid by you for the relevant product.

 

Force majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
 

  • Strikes, lock-outs or other industrial action;

  • Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

  • Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

  • Impossibility of the use of public or private telecommunications networks;

  • The acts, decrees, legislation, regulations or restrictions of any government.
     

Our performance under any order is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the Force Majeure Event.

                                                                                                                             

Entire agreement

These Conditions, together with the details contained in your order confirmation, constitute the entire agreement between us in relation to your order and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. You acknowledge that you have not relied on any other statement, promise or representation in entering the contract.

 

Severability

If any of these terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

 

Notices

All notices under these Conditions must be in writing and sent to us at the address or email set out on our website. We may send notices to you using the contact details provided in your order. Notices sent by email are deemed received at the time of transmission. Notices sent by post are deemed received two working days after posting.

 

Complaints

If you have a complaint or concern regarding your order, please contact us at support@studio-marsa.com. We aim to respond to all complaints within 5 working days and to resolve issues as quickly as reasonably possible.

 

Variations

We may update or amend these Conditions from time to time. The Conditions applicable to your order are those in force at the time you submitted your order. Any changes to these Conditions will not apply retroactively to existing contracts unless required by law.

 

No waiver

Any delay or failure by us to exercise any right or remedy under these Conditions shall not constitute a waiver of that right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. A waiver of any right or remedy will only be effective if given in writing.

 

Intellectual property

All designs, images, drawings, product descriptions, text, logos, trademarks, and other content on our website or provided as part of the order process are owned by or licensed to us. They may not be reproduced, copied, distributed, or used for any purpose without our prior written permission.

Any bespoke designs or design amendments created for your order remain our intellectual property unless expressly agreed otherwise in writing.

 

Governing law

These Conditions and any contract between us are governed by the laws of England and Wales. Any dispute arising from, or related to, such contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Data protection & Privacy

We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Personal data is used only as necessary to process and fulfil orders, arrange delivery, communicate with customers, and comply with legal obligations. We do not sell your personal data to third parties. Further details are set out in our Privacy Policy.
